1 Acceptance of Terms
Welcome to Cabiux. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and Cabiux Inc. ("Cabiux", "Company", "we", "us", "our") governing your access to and use of the Cabiux platform, including our website, applications, APIs, and all related services (collectively, the "Service").
By Using Our Service, You Agree To:
- These Terms of Service in their entirety
- Our Privacy Policy, which describes how we collect, use, and protect your personal information
- Our Acceptable Use Policy, which outlines permitted and prohibited uses of the Service
- Any additional terms that may apply to specific features or services
Important: If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service constitutes ongoing acceptance of these Terms as they may be modified from time to time.
Legal Capacity
By agreeing to these Terms, you represent and warrant that:
- You are at least 18 years of age, or the age of legal majority in your jurisdiction
- You have the legal capacity to enter into binding contracts
- If you are accepting these Terms on behalf of an organization, you have the authority to bind that organization to these Terms
- You are not prohibited from using the Service under the laws of your jurisdiction
2 Definitions
Throughout these Terms, the following definitions apply:
"Account"
Your registered account on the Cabiux platform, including all associated data, settings, and configurations.
"Content"
Any data, text, URLs, images, or other materials that you submit, post, or transmit through the Service.
"Link" or "Smart Link"
A shortened URL or deep link created through the Service that redirects to a destination URL.
"Deep Link"
A link that directs users to specific content within a mobile application or website.
"Analytics Data"
Statistical information collected about link clicks, including geographic location, device type, referrer, and timestamp.
"API"
The Application Programming Interface provided by Cabiux for programmatic access to the Service.
"Subscription"
A paid plan that provides access to premium features and increased usage limits.
"Custom Domain"
A domain name owned by you that is configured to work with the Cabiux service for branded links.
3 Description of Service
Cabiux provides a comprehensive link management platform designed to help marketers, businesses, and developers create, manage, and analyze links across digital channels.
Core Services Include:
- Link Shortening: Create compact, shareable URLs from long destination addresses
- Deep Linking: Generate universal links that route users to mobile apps or websites based on context
- Analytics Dashboard: Track clicks, geographic distribution, devices, referrers, and conversion metrics
- QR Code Generation: Create scannable QR codes for any link
- A/B Testing: Split traffic between multiple destinations to optimize performance
- Custom Domains: Use your own branded domains for links (available on select plans)
- Geo-Targeting: Route users to different destinations based on their geographic location
- Device Targeting: Direct users to platform-specific destinations
- REST API: Programmatic access for creating and managing links
- Tracking Pixels: Integration with Facebook Pixel, Google Analytics, and custom tracking
Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for significant changes that affect your use of the Service.
4 Account Registration
Creating an Account
To access most features of the Service, you must register for an account. When creating an account, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information as necessary
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
Account Security
You are responsible for maintaining the security of your account credentials. We recommend:
- Using a strong, unique password that you don't use elsewhere
- Not sharing your account credentials with others
- Regularly reviewing your account activity for unauthorized access
- Logging out from shared or public devices
Warning: We will never ask for your password via email or phone. If you receive such a request, do not respond and report it to our security team immediately.
Account Restrictions
- Each individual or entity may maintain only one account
- Accounts are non-transferable without our written consent
- Business accounts must be registered using a company email address
- We reserve the right to refuse registration or cancel accounts at our discretion

Billing Terms
- Payment Processing: All payments are processed securely through Stripe. We do not store your complete credit card information.
- Billing Cycle: Subscriptions are billed in advance on a monthly or annual basis, depending on your chosen billing period.
- Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
- Price Changes: We will provide at least 30 days notice before implementing any price increases. Current subscribers will be notified via email.
Refund Policy
We want you to be satisfied with our Service. Our refund policy is as follows:
- Monthly Plans: No refunds for partial months. You may cancel at any time and continue to use the Service until the end of your billing period.
- Annual Plans: Refunds may be requested within 14 days of the initial purchase or renewal. After 14 days, no refunds will be issued, but you may cancel to prevent future renewals.
- Downgrades: When downgrading to a lower-tier plan, the change takes effect at the start of your next billing cycle. No prorated refunds are provided.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation:
- Your subscription will remain active until the end of your current billing period
- You will not be charged for subsequent billing periods
- Your links will continue to work, but analytics access may be limited
- After your subscription expires, you will need to subscribe again to access premium features
6 Acceptable Use Policy
To maintain a safe and reliable Service for all users, you agree to use Cabiux only for lawful purposes and in accordance with these Terms.
You May Use the Service To:
- Create short links and deep links for legitimate marketing, communication, and business purposes
- Track analytics for links you have created
- Integrate with your applications and websites using our API
- Create QR codes for physical or digital distribution
- Conduct A/B tests to optimize your marketing campaigns
You Must Not:
- Use automated systems, bots, or scripts to create links without explicit authorization
- Attempt to reverse engineer, decompile, or extract source code from the Service
- Circumvent any rate limits, access controls, or security measures
- Use the Service to interfere with or disrupt other users or third-party services
- Resell or redistribute the Service without our written consent
- Use the Service in violation of any applicable laws or regulations
- Impersonate Cabiux, our employees, or other users
- Create links that artificially inflate click counts or analytics data
7 Prohibited Content
You may not use Cabiux to create links to content that is illegal, harmful, or violates the rights of others. Prohibited content includes, but is not limited to:
Strictly Prohibited:
- Malware & Viruses: Links to software designed to damage, disrupt, or gain unauthorized access to computer systems
- Phishing: Links designed to deceive users into revealing sensitive information such as passwords, credit card numbers, or personal data
- Fraud & Scams: Links promoting fraudulent schemes, pyramid schemes, or deceptive business practices
- Illegal Content: Links to content that violates local, national, or international laws
- Child Exploitation: Any content involving minors in a harmful or exploitative manner
- Violence & Terrorism: Content promoting violence, terrorism, or extremist activities
- Hate Speech: Content that promotes hatred, discrimination, or violence against individuals or groups based on protected characteristics
- Copyright Infringement: Links to pirated software, movies, music, or other copyrighted materials
- Spam: Mass distribution of unsolicited links through email, social media, or other channels
Enforcement: We actively monitor for prohibited content and may disable links or terminate accounts without notice if violations are detected. Serious violations may be reported to law enforcement authorities.
8 Link Content & Responsibility
Your Responsibility
You are solely responsible for:
- The content of all destination URLs you link to through the Service
- Ensuring your links comply with all applicable laws and regulations
- Obtaining any necessary permissions or licenses for linked content
- The accuracy and appropriateness of any link descriptions or metadata
Link Monitoring
We reserve the right to:
- Monitor links for compliance with these Terms
- Scan destination URLs for malware or prohibited content
- Disable links that violate our policies without prior notice
- Cooperate with law enforcement investigations
Link Availability
While we strive to maintain link availability, we do not guarantee that links will remain active indefinitely. Links may be disabled due to:
- Policy violations
- Account termination or expiration
- Technical issues or service maintenance
- Legal requirements or takedown requests
Data Retention by Plan
Analytics data is retained according to your subscription plan. After the retention period expires, historical data may be deleted. Links themselves remain active as long as your account is in good standing.
9 API Terms of Use
Access to the Cabiux API is provided as part of all subscription plans. By using the API, you agree to the following additional terms:
API Access
- API keys are unique to your account and must be kept confidential
- You may not share, sell, or transfer your API keys to third parties
- You are responsible for all API calls made using your credentials
- API access may be revoked if these Terms are violated
Rate Limits
API requests are subject to rate limits based on your subscription plan:
- Small Plan: 100 requests per minute
- Medium Plan: 500 requests per minute
- Large Plan: 2,000 requests per minute
Exceeding rate limits will result in temporary request throttling. Persistent abuse may result in API access suspension.
API Usage Guidelines
- Implement reasonable caching to minimize redundant API calls
- Handle rate limit responses (HTTP 429) gracefully with exponential backoff
- Do not use the API to scrape or harvest data from the Service
- Attribute links created through the API to your Cabiux account
10 Intellectual Property
Cabiux Intellectual Property
The Service, including its design, architecture, features, user interface, underlying code, and all related intellectual property, is owned by Cabiux Inc. and protected by copyright, trademark, patent, and other intellectual property laws.
You may not:
- Copy, modify, or create derivative works based on the Service
- Use our trademarks, logos, or branding without written permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove or alter any copyright, trademark, or other proprietary notices
Your Content
You retain ownership of any content you submit to the Service. By using the Service, you grant Cabiux a worldwide, non-exclusive, royalty-free license to:
- Store and process your content to provide the Service
- Display link metadata and analytics as part of the Service
- Create aggregated, anonymized statistics about Service usage
Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use such feedback without any obligation to compensate you.
11 Data & Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Data We Collect
- Account Information: Email address, name, and payment information
- Link Data: URLs you create, destinations, and configurations
- Analytics Data: Click data including IP addresses, geographic location, device information, and referrer URLs
- Usage Data: How you interact with the Service, including features used and actions taken
Data Protection
We implement industry-standard security measures to protect your data, including:
- Encryption of data in transit (TLS 1.3) and at rest
- Regular security audits and vulnerability assessments
- Access controls and authentication requirements
- Secure data centers with physical security measures
Data Export
You may export your data at any time through the dashboard or API. Upon account termination, you may request a data export within 30 days.
12 Service Availability
Uptime Commitment
We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Emergency maintenance to address security vulnerabilities
- Technical issues beyond our reasonable control
- Force majeure events (natural disasters, wars, government actions)
Service Modifications
We may modify, update, or discontinue features of the Service at any time. For significant changes:
- We will provide at least 30 days notice for features essential to your use
- We will offer migration paths or alternatives when feasible
- Changes necessary for legal compliance or security may be implemented immediately
Support
Technical support is available via email for all subscribers. Response times vary by plan tier. We do not provide phone support at this time.
13 Limitation of Liability
Please read this section carefully as it limits our liability to you.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CABIUX, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Cost of substitute goods or services
- Damages arising from your use or inability to use the Service
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
14 Indemnification
You agree to indemnify, defend, and hold harmless Cabiux, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Content you submit, post, or transmit through the Service
- Any claim that your content caused damage to a third party
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate with our defense of such claim.
15 Termination
Termination by You
You may terminate your account at any time by:
- Cancelling your subscription through account settings
- Contacting our support team to request account deletion
Termination by Us
We may suspend or terminate your account immediately, without prior notice or liability, if:
- You violate these Terms or our policies
- We are required to do so by law
- Your account has been inactive for an extended period
- We reasonably believe your account is being used for fraudulent or illegal purposes
- We discontinue the Service (with reasonable notice when possible)
Effect of Termination
Upon termination:
- Your right to access and use the Service will immediately cease
- Your links may be disabled or removed
- We may delete your account data after 30 days
- You may request a data export within 30 days of termination
- Provisions of these Terms that should survive termination will remain in effect (including Sections 10, 13, 14, and 16)
16 Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact us at legal@cabiux.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.
Arbitration Agreement
If we cannot resolve a dispute informally, you and Cabiux agree to resolve any claims through final and binding arbitration, except as set forth below. The American Arbitration Association (AAA) will administer the arbitration under its Commercial Arbitration Rules.
Exceptions to Arbitration
- Either party may bring a lawsuit in small claims court if the claim qualifies
- Either party may seek injunctive relief in any court of competent jurisdiction
- Claims relating to intellectual property rights are not subject to arbitration
Class Action Waiver
YOU AND CABIUX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Jurisdiction
For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.
17 Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes:
Notification
- Material Changes: We will notify you via email at least 30 days before the changes take effect
- Minor Changes: We will update the "Last Updated" date and post the revised Terms on our website
- Emergency Changes: Changes required for legal compliance or security may be implemented immediately
Your Options
If you disagree with the updated Terms:
- You may terminate your account before the new Terms take effect
- Continued use of the Service after the effective date constitutes acceptance of the new Terms

We maintain a history of previous versions of these Terms. You may request access to previous versions by contacting us.
